Classification of Common courts

Common courts are classified three levels:

(1) District Court

(2) High Court

(3) Supreme Court

I. The District Court is responsible for the following

(1) The first instance of the civil or criminal action, which does not include cases specified by other regulations of the law (such as the first instance of a criminal action concerning civil strife, foreign aggression or violation of foreign relations).

(2) Litigation cases specified by other laws (such as election litigation, traffic adjudication, juvenile reformation training, etc.).

(3) Non-litigation cases specified by legislation.

II. The High Court is responsible for the following:

(1) The first instance of a criminal action concerning civil strife, foreign aggression or violation of foreign relations.

(2) A civil or criminal case which appeals against a decision of the first instance made by the district court or its branches. But the case under the other regulations of the laws (e.g. that the appeal or counter-appeal against the decision made by the simple courtroom of the district court should be judged by the collegial panel of the district court) should be conducted in accordance with the relevant legislation.

(3) Counter-appeals decisions made by the district court or its branches.

(4) Litigation cases specified by the other laws (such as election litigation).

III. The Supreme Court is responsible for the following:

(1) A civil or criminal case which appeals against the decision of the first instance made by the high prosecutors' office or its branches.

(2) A civil or criminal case which appeals against the decision of the second instance made by the high prosecutors' office or its branches.

(3) A counter-appeal against the decision made by the high prosecutors' office or its branches.

(4) Special litigation cases.

(5) Litigation cases specified by the other laws (e.g.: the second instance of the simple proceedings with the claimed amount over the amount set forth in Article 466 of the Civil Procedure Law should appeal or counter-appeal to the Supreme Prosecutors' Office against the alleged misuse of the applied laws).
